Terms of Service

These Terms apply to LeapTrack services provided in Australia.

1. Introduction and acceptance

These Terms of Service (the "Terms") govern your use of LeapTrack. By activating an account or using the service, you agree to these Terms. If you do not agree, you must not use LeapTrack. If you are using LeapTrack on behalf of a club or course operator, you confirm you are authorised to accept these Terms on its behalf.

If you are an owner, course administrator or coach, you must also accept our Staff & Coach Acceptable Use and Confidentiality Addendum, which sets out additional obligations that apply to staff who can see children's information.

2. About the service

LeapTrack is a sports skill-tracking platform that lets clubs and course operators record young athletes' skill results and, where the club has arranged for it, training photos and videos, term by term, and lets parents and carers follow their own child's progress. LeapTrack is operated by Insightify Pty Ltd (ABN 55 662 709 640), trading as LeapTrack.

3. Eligibility and accounts

Access to LeapTrack is invitation-only and role-based — there is no public self sign-up. Accounts are created when an administrator invites a staff member or parent/carer, who then activates the account by setting a password. You are responsible for keeping your login details secure and for all activity that occurs under your account. You must provide accurate information and keep it up to date.

4. Acceptable use

You agree not to:

• use LeapTrack for any unlawful purpose or in breach of these Terms;
• access, or try to access, data — including photos or videos — you are not authorised to see;
• share your account credentials or let others use your account;
• upload harmful, offensive or infringing content, including photos or videos taken without appropriate consent;
• use a child's photos, videos or results outside the platform for any purpose other than the authorised purpose they were recorded for; or
• interfere with, disrupt, or attempt to compromise the security of the service.

5. Club responsibilities

Clubs and course operators are responsible for the information they enter into LeapTrack, including any photos or videos recorded during sessions. In particular, a club must obtain appropriate consent from a parent or carer before entering a child's personal information into the platform or recording any photo or video of that child, and must ensure the information it records is accurate and used appropriately. Clubs are responsible for managing who they invite and for the conduct of their own staff and members, including how coaches capture and handle photos or videos.

6. Intellectual property

LeapTrack, including its application, design, branding and content (excluding data, photos, videos, or other content you or your club enter), is owned by Insightify Pty Ltd and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms. You may not copy, modify, reverse-engineer or resell any part of the service without our permission.

7. Data and privacy

Our handling of personal information, including photos and videos, is described in our Privacy Policy, which forms part of these Terms. Because LeapTrack holds information about children, both we and clubs share responsibility for handling that information carefully and lawfully. Authorised LeapTrack personnel may access your account to provide support, troubleshoot issues, or maintain platform security; such access is limited to the smallest number of people necessary, is only used for the purpose requested, and is never shared with, or used to compare data against, other clubs.

8. Fees and billing

Fees for LeapTrack are agreed separately with each club or course operator. Parents and carers are never charged by LeapTrack — there is no cost to a parent or carer for a child's record, for access to their child's progress, or for the ongoing history of that progress. If our standard pricing changes, or if we introduce new charges for a club, we will present that pricing to the club for agreement before any fees are charged.

9. Availability and no warranty

We work to keep LeapTrack available and reliable, but the service is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, or that it will meet every requirement. To the extent permitted by law, we exclude all implied warranties. Nothing in these Terms excludes any rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by law, Insightify Pty Ltd is not liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill, arising out of or in connection with your use of LeapTrack. Where our liability cannot be excluded but can be limited, our liability is limited to re-supplying the service or paying the cost of having it re-supplied.

11. Suspension and termination

We may suspend or terminate access to LeapTrack if these Terms are breached, if it is necessary to protect the service or its users, or if required by law. You or your club may stop using the service at any time. Before deleting a club's data — including photos and videos — following termination, we will provide a reasonable opportunity (for example, 30 days) to export it, except where earlier deletion is required by law or requested by the club. Subject to that, we will handle any remaining data in accordance with our Privacy Policy and applicable law.

12. Governing law

These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will publish a new version number and date above and ask you to review and accept the updated Terms before you continue using the platform.
